Introduction

This Privacy Policy explains how devFactory ("devFactory", "we", "us") collects, uses, discloses, and safeguards information in connection with our website, our ERP/CRM platform (including devyCRM), and our messaging integrations with the WhatsApp Business Platform (Meta). It applies both to individuals who interact with us directly and to the businesses that use our software to manage their own customers.

Our Two Roles (Controller and Processor)

Depending on the data involved, devFactory acts in one of two roles:

• As a data controller — for information about our own website visitors, leads, and the businesses that contract our services (e.g., account, billing, and support data).
• As a data processor / technology provider — when a business client uses devyCRM to communicate with their customers over WhatsApp. In that case the business client is the controller of their customers' data, and devFactory processes that data on the client's behalf and under their instructions, solely to provide the service.

Information We Collect

• Information you provide: name, email address, phone number, company details, and any content you submit (forms, messages, support requests).
• Business account data: for client businesses, the data needed to operate the service, including WhatsApp Business Account identifiers, phone number IDs, and configuration.
• Messaging data (WhatsApp Business Platform): when devyCRM is connected to WhatsApp, we process the messages exchanged, contact phone numbers, display names, message templates, and related metadata, in order to deliver, display, and manage those conversations within the platform.
• Automatically collected data: IP address, browser type, device and operating system, pages visited, and similar technical data collected via cookies and analytics to operate and improve our services.

How We Use Information

• Provide, operate, and maintain our website and the devyCRM/ERP platform.
• Enable client businesses to send and receive WhatsApp messages with their own customers, and to create and manage WhatsApp message templates.
• Authenticate users, provide support, and respond to inquiries.
• Improve features, security, and user experience.
• Send service and, with appropriate consent, marketing communications.
• Comply with legal obligations and enforce our terms.

WhatsApp Business Platform & Meta

devFactory integrates with the WhatsApp Business Platform and uses Meta's APIs to send and receive messages on behalf of our client businesses. To deliver this functionality, certain data (such as recipient phone numbers and message content) is processed by and shared with Meta Platforms, Inc. in accordance with Meta's terms and policies. Our use of information received through Meta APIs adheres to the Meta Platform Terms and the WhatsApp Business Messaging Policy. We do not use data obtained through these APIs for purposes other than providing and improving the service, and we do not sell it. Meta's own handling of data is governed by the WhatsApp Privacy Policy.

Sharing Your Information

We do not sell personal information. We may share information with:

• Meta / WhatsApp, as needed to deliver messaging functionality.
• Trusted service providers (e.g., hosting, infrastructure, analytics) who process data on our behalf under confidentiality and data-protection obligations.
• Our client businesses, with respect to the conversations and contacts that belong to them.
• Authorities, when required by law or to protect rights, safety, and security.

Data Retention

We retain personal and messaging data only for as long as necessary to provide the service, comply with legal obligations, resolve disputes, and enforce our agreements. Data processed on behalf of a client business is retained according to that client's instructions and deleted or returned when the relationship ends, subject to legal retention requirements.

Your Rights

You have the right to access, update, rectify, or delete your personal information, and to object to or restrict certain processing. In Argentina, these rights are recognized under Ley 25.326 de Protección de Datos Personales (the data-protection authority is the AAIP). If your data is processed by devyCRM on behalf of a business client, please contact that business (the controller); we will assist them as their processor. Security

We apply reasonable technical and organizational measures to protect information against unauthorized access, loss, or misuse, including access controls and encryption of sensitive credentials. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

Our website uses cookies and similar technologies for functionality and analytics (to understand usage and improve our services). You can control cookies through your browser settings; disabling them may affect some features.

Children's Privacy

Our services are intended for businesses and adults. We do not knowingly collect personal information from children.
